If your property is located in the Designated Floodway Fringe Area, special floodproofing requirements may apply to your project.
The City enforces the Floodway Fringe Area Regulation for:
- Residential & commercial buildings
- Additions
- Accessory structures (garage, shed, deck, pool, etc.)
These requirements help reduce flood damage and the need for temporary flood protection on properties outside of Winnipeg’s primary dike system.

Your property title may also include a caveat or easement. This may mean that:
- an existing building or structure does not meet current Floodway Fringe Area Regulation requirements
- the City approved a variation to floodproofing requirements
- future property owners must maintain the floodproofing measures listed in a variation permit, unless the City approves a change
- a variation permit does not affect eligibility for flood protection or flood damage assistance
Plan your development or construction project
Projects in the Designated Floodway Fringe Area must meet floodproofing requirements. These requirements may apply to the site, building elevation, openings, and building systems.
Before you apply, contact wwd-floodprotection@winnipeg.ca to confirm the Flood Protection Level (FPL) for your property.
Possible project requirements:
• Raise the ground around a proposed building or structure to the required FPL.
• Build the main floor at the required elevation.
• Do not include openings below the FPL, including windows and doors.
• Install electrical panels, water shut-off valves, and backwater valves as required by the regulation.
The City may ask for a geodetic survey to review your proposed development. Survey elevations must use the horizontal North American Datum of 1983, NAD83 (June 1990) and Canadian Geodetic Vertical Datum of 1928, CGVD28.
Per Section 158(2) and (3) of the City of Winnipeg Charter, no construction is allowed in a Designated Floodway Area unless it is Public Service Works. Contact wwd-floodprotection@winnipeg.ca before planning work in a Designated Floodway Fringe Area.
Request a floodproofing variation
You are responsible for meeting the regulation requirements. Only request a variation if it's not possible to meet the requirements.
A variation may be considered when:
- placing fill could affect riverbank stability
- a small lot cannot accommodate the required berm width or side slopes
- meeting the requirements would create a building that is significantly out of character with nearby properties
What you need to provide
- A professional engineer must propose and certify alternative flood protection measures that are acceptable to the City.
- You must pay the applicable variation fee found in the Planning, Development & Building Fees and Charges.
- You must register a legal caveat on the property title through Teranet Manitoba before the City will issue a building permit.
A variation request can add several weeks to the development permit approval process.
Applying for a building permit
You can apply for a building permit:
- after submitting a complete development permit application, through a concurrent review; or
- after your development permit is approved, through a sequential review.
Your building permit application must match your development permit application or approval.
For most projects, other than accessory structures, the City issues the building permit in two stages:
- Foundation permit
Allows you to build the foundation.
- Superstructure permit
Allows you to continue construction after:- the foundation is complete; and
- you submit a surveyor's certificate, or another document approved by the City, showing that the foundation meets the required floodproofing elevation
