By-law drafted to address nuisance demonstrations, keeping Winnipeggers safe at designated locations

Safe Access to Vulnerable Infrastructure By-Law ready for Council consideration

Winnipeg, MB – A new by-law designed to protect both access to community spaces and Winnipeggers’ right to gather for what they believe in is ready for Council’s consideration.

The Safe Access to Vulnerable Infrastructure By-law would set limits on how close nuisance demonstrations can be to certain types of buildings including places of worship, schools, childcare centres, and other designated facilities.

It would also allow  fines for anyone who engages in the intimidation of any person accessing or attempting to access a designated facility..

“While we completely respect and value peoples’ right to gather and express themselves, we have a duty to ensure all spaces are safe and accessible to those who want or need to visit them,” said Councillor Evan Duncan, who in early 2025 put forward the motion that directed the Public Service to draft the by-law.

“Every Winnipegger has the right to safely access places of worship, healthcare providers, and other facilities without fear, intimidation, or obstruction. That right must be respected and protected,” said Duncan.

The draft by-law sets different levels of fines for breaking the rules, following The Provincial Offences Act. It recommends $500 for a first offense, with fees escalating to $5,000 for third and subsequent offences. It would be enforced by by-law officers and the Winnipeg Police Service.

Executive Policy Committee will consider the recommended by-law at its February 17, 2026 meeting before sending it to Council for final consideration on February 26.
