These condition of use (“Conditions of Use”) apply to all of The City of Winnipeg (the “City”) websites, unless otherwise stated on such website.
This website is owned and operated by the City. Your access to, and use of, this website, MyAccount and the AI Chatbot are governed by these Conditions of Use.
1. Definitions
1.1 – “AI Chatbot” or “Chatbot” means a software application made available through the Winnipeg.ca website that uses artificial intelligence to simulate human conversation through text and attempt to answer User’s questions.
1.2 – “MyAccount” means an online portal containing information and Website Content that may be specific to your access and use of specific City services, which you may access through the creation of a User Profile.
1.3 – “Personal Information” has the meaning assigned to it in FIPPA.
1.4 – “Profile Information” means the administrative information included in a person’s User Profile, such as a person or entity’s user ID, password/PIN, security question and answer, and login information.
1.5 – “User Profile” means the online account you create and access through MyAccount that is linked to an email address and may contain Profile Information.
1.6 – “User Content” means information submitted by you that is accessible through MyAccount and includes any Profile Information, financial information, or Personal Information which you submit to MyAccount, this website or other City owned and operated portal or website.
1.7 – “Website Content” means any and all information on or accessed through the website and/or MyAccount including, but not limited to, all information, text, images, data, code, graphics, icons, knowhow, materials, and resources used in the presentation, development, and arrangement of the website. Website Content does not include User Content.
1.8 – “You”, “you”, “Your”, “your” and "User" means the person accessing and using this website or MyAccount and if that person is accessing or using this website or MyAccount on behalf a corporation, partnership, joint venture or other entity that corporation, partnership joint venture or other entity.
2. Access and Use – General
2.1 – The City grants to you a limited license to display on your computer, print, download and use all Website Content that is made available to you on this website or through MyAccount only if you agree and act in accordance with these Conditions of Use.
2.2 – You agree that you:
- Will only use the website and/or your User Profile through MyAccount for personal, educational or non-commercial purposes, unless expressly permitted by the City in writing or in these Conditions of Use.
- In accessing or using the website and/or MyAccount or any City services or submitting any information or materials to the City, shall act in compliance with all applicable laws and regulations, and by-laws.
- Shall not violate (or attempt to violate) the security of this website and/or MyAccount by hacking, cracking, mail bombing, mounting a denial of service attack, post, transmit, link to or otherwise distribute any information or software which contains a virus, or other harmful or disruptive property or component that may adversely affect this website or MyAccount, or engage in any other similar malicious, careless or negligent conduct.
- Shall not upload content or computer code of any type to this website or MyAccount, unless expressly permitted by the City in these Conditions for Use.
- Shall not post, transmit, link to or otherwise distribute any inappropriate, defamatory, indecent, offensive or unlawful material or information.
3. Copyright and Trademark Notice
3.1 – This copyright notice (“Copyright Notice”) applies to all the City’s websites, except for the information available at data.winnipeg.ca which is licensed under the terms of the Open Data/Government License.
3.2 – While the City provides information on its websites to Users it retains copyright on all Website Content made available on its websites.
3.3 – You understand and agree that except for the limited license to access and use the website and MyAccount as set out in these Conditions of Use, you have no right to the intellectual property associated with this website. This means that you are not permitted, without the express written permission of the City to:
- Distribute all or any portion of Website Content, in any way, shape or form, to anyone for any reason.
- "Mirror" or display all or any portion of the Website Content on your or anyone else’s website.
- Modify or re-use all or any portion of the Website Content on the City’s websites.
- Provide a link to this website from your or anyone else’s website.
3.4 – You may:
- Print copies of the Website Content strictly for your own personal use.
- Reference this website from your own documents.
3.5 – Commercial or any other use of all or any portion of the Website Content is prohibited without the written permission of the City. In all copies of the Website Content, except as specifically listed above, you must retain this notice and any other copyright notices originally included with the Website Content.
3.6 – The City logo, crest and banner, and all trademarks of the City are registered trademarks, or used as trademarks, of the City. You are not permitted to use, reproduce, modify or distribute the City’s trademarks for any reason without the City’s express written permission.
3.7 – All other tradenames, product names, logos or trademarks mentioned or displayed on this website not owned by the City are the property of their respective owners.
3.8 – Specific permission for reproduction or use of City trademarks, logos, or copyrighted works for any purpose must be obtained from the City by contacting:

3.9 – The City reserves all other rights.
4. Privacy and Personal Information
4.1 – Any Personal Information collected by the City through this website is collected pursuant to s.36(1)(b) of The Freedom of Information and Protection of Privacy Act (CCSM c F175). Your Personal Information will only be used for communication and for the purpose for which it was collected, which may include administration of your account, providing you information, or providing you with services. We do not use or share your personal information for other purposes unless authorized by law or with your consent.

5. User Content
By uploading User Content to this website or MyAccount, you grant the City a license to use, copy, modify, distribute, share and store your User Content for the sole purpose of providing you with City related services.
6. Communications
6.1 – The City may send you information, messages or notifications through your MyAccount User Profile or via other electronic means. By providing your contact information through this website or by creating a User Profile, you consent to the City contacting you in this manner.
6.2 – You understand and agree that creating a User Profile may mean you no longer receive communications from the City through regular mail.
6.3 – For more information about how the City may use your Personal Information, please see the Privacy Statement.
7. Changes to these Conditions of Use
7.1 – The City may make revisions or updates to these Conditions of Use from time to time. It is your responsibility to check this website regularly to check for any updates or revisions. If you have a User Profile through MyAccount, you agree such revisions, updates, or changes to these Conditions of Use may be sent to you as a notification via MyAccount, or by email. Your continued use of the website and/or MyAccount constitutes acceptance of any changes to these Conditions of Use. If you do not agree with any changes, your sole remedy is to cease accessing and using this website and MyAccount.
7.2 – If you have a User Profile with MyAccount, you have a period of fourteen (14) days where you may withdraw from these Conditions of Use if you disagree with any revisions made to these Conditions of Use. This period begins from date on which you are notified of the revisions or changes through your User Profile or by email. If you do not agree to the revisions or changes, you must immediately exit and stop using MyAccount. It is understood that any access to or use of MyAccount conducted during this 14-day period will not be affected by your later withdrawal under this subsection. Your continued use of MyAccount after the 14-day period constitutes acceptance of any changes to these Conditions of Use.
8. Mapping Specific Conditions of Use
If you are accessing or using any maps on this website, the mapping conditions of use will apply to your access and use of such maps, in addition to these Conditions of Use.
9. MyAccount Specific Conditions of Use
9.1 – Some online City services require that you have an account in order to access those services. The City permits you to create a User Profile through MyAccount, which enables you to access Website Content and more online services specific to you.
9.2 – You must accept these Conditions of Use in order to register a User Profile to access and use MyAccount. You are not permitted to register a User Profile or to access or use MyAccount if you do not accept these Conditions of Use. If you do not agree with these Conditions of Use, you must immediately exit and stop using MyAccount. If you have created a User Profile, you must immediately delete your User Profile by following the instructions provided in MyAccount.
9.3 – By checking the box displayed on the MyAccount registration page, you certify that:
- you have read and understood these Conditions of Use, and expressly accept and agree to comply with and be bound by them;
- if you are agreeing to these Conditions of Use on behalf of another person or an entity you have the right or authorization to accept these Conditions of Use for that other person or entity,
- if you are agreeing to these terms on behalf of another person or entity, that person or entity is deemed to be bound by these Conditions of Use.
9.4 – The City may grant you access to other City accounts or portals, or may provide you with access to content you provide to the City through other accounts or portals through MyAccount.
9.5 – If you can access another City account or portal, such as MyUtility, through MyAccount, your access of that account or portal shall be subject to the terms and conditions of that account or portal. These Conditions of Use shall only apply, if refenced in the applicable terms and conditions of that account or portal.
9.6 – By using and accessing MyAccount, you understand and agree that your content, including Personal Information that you provide the City through other services, accounts or portals may be made accessible to you through MyAccount.
10. MyAccount Registration Requirements
To create a User Profile with MyAccount:
- you must be 18 years or older,
- you must reside or conduct business in the city of Winnipeg.
11. MyAccount User Profile Security
11.1 – By creating a User Profile, you agree to provide accurate and current information as required for your User Profile and to update your information in a timely manner to ensure it remains accurate and complete.
11.2 – You are solely responsible for what you do with your user Profile, including taking reasonable steps to keep your user Profile secure. The City shall not be liable to you for any inaccurate user Content or for any unauthorized access of your User Profile.
11.3 – You are solely responsible for maintaining the confidentiality of your User Profile, Profile Information, User Content and any Profile Information or User Content that you download, upload access, view, or otherwise extract or copy from or to MyAccount.
11.4 – You will immediately notify the City if you believe that anyone may have accessed your account without permission or that information provided to the City through your User Profile is incorrect.
11.5 – You shall not:
- use your User Profile for any illegal or improper purposes
- if you created or access the User Profile on behalf of another person or entity, access or use the User Profile without their express consent and direction;
- access MyAccount via a computer or other electronic device that you know or reasonably should know contains software with the ability to reveal or otherwise compromise any of your Profile Information or User Content; and
- share or disclose your Profile Information with others, and if you need to share your Profile Information with anyone, you understand and agree that you are responsible for ensuring the compliance of anyone with whom you share or to whom you disclose your Profile Information.
11.6 – You are solely responsible for ensuring that you receive and regularly review your User Profile, and for the protection and recovery of your computer system. You must take reasonable and appropriate precautions to ensure that any computer system used to access your User Profile is secure and free of viruses or other harmful or destructive properties or components. If you access your User Profile from a shared device or a device you do not own, you do so at your own risk and you understand that you are solely responsible for ensuring the security of your User Profile.
12. MyAccount Availability
12.1 – You agree that the City may change, suspend or discontinue any of the services or information available to you through MyAccount.
12.2 – The City may delete your User Profile if your User Profile has been inactive for a long time. Your User Content and Profile Information will be stored and deleted in accordance with the City’s Records Management By-law.
13. Disclaimers
13.1 – This website and MyAccount are provided “AS IS” and the City does not make any warranties, representations, or guarantees, whether express or implied, (collectively, "Warranties") with respect to the website, AI Chatbot, MyAccount, City services, or Website Content, including, without limitation, warranties that: the website, AI Chatbot, MyAccount, service, or Website Content will be error-free, free of viruses or other harmful or destructive properties or components, or provided without interruption; warranties as to the accuracy, validity, correctness, currency, timeliness, completeness, reliability, quality, or adequacy of the website, AI Chatbot, City services, or content, or for any linked third party websites or information; and warranties of merchantability, title, non-infringement, or fitness for a particular purpose. Website Content has been compiled from a variety of sources and is subject to change without notice to you from the City. The City also expressly disclaims the aforesaid Warranties and any liability therefor. If you are dissatisfied or disagree with all or any part of these conditions of use, or any rules, policies, or practices the City may implement or enforce regarding this website, the AI Chatbot, or MyAccount, your sole and exclusive remedy is to discontinue using this website, the AI Chatbot and/or MyAccount.
13.2 – The City’s provision of links to websites not maintained, owned or operated by the City does not imply approval, warrant the quality, content, accuracy or completeness of any information, or endorse any opinion expressed on any of these external websites. The City may in its sole discretion, accept or deny any requests for references to, or links to, third party sites.
13.3 – Communications made through the City’s email messaging system, AI Chatbot or through MyAccount shall in no way be deemed to constitute legal notice to the City or any of its agencies, offices, employees or representatives with respect to any existing or potential claim or cause of action against the City or any of its agencies, officers, servants, agents, employees, or representatives, where notice to the City is required by provincial, federal or local laws, rules or regulations.
14. Liability
14.1 – You agree that under no circumstances is the City and its council, committees of council, affiliated bodies, officers, directors, employees, agents, and other representatives (collectively, "Representatives") liable or responsible for any direct, indirect, incidental, consequential, punitive, or special damages, including, without limitation, any loss of use, lost data, lost business profits, business interruption, personal injury, property damage, or any pecuniary loss arising out of or in any way connected with your (1) access to or use of the website, AI Chatbot, MyAccount, or the website content; and/or (2) any information or content you send to the City; and/or (3) the use of links to third party websites, whether or not any such damages are or might be foreseeable, or caused in whole or in part by the negligence of the City, and even if the City is informed of their possibility, whether based in contract, tort (including negligence), equity, strict liability, or otherwise.
14.2 – Without limiting the generality of the foregoing, the City assumes no responsibility and shall not be liable for any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the website, AI Chatbot or MyAccount, or your downloading of any website content from the website, AI Chatbot or MyAccount.
15. Indemnity
You agree to defend, indemnify, and hold harmless the City and its Representatives from and against any and all losses, costs, damages and expenses, including reasonable legal fees, suffered or incurred by the City as a result of or in connection with your use and/or your access of this website, AI Chatbot, MyAccount and/or the website content.
16. AI Chatbot Specific Conditions of Use
The AI Chatbot is made available to Users as a pilot, test project.
Use of the Chatbot is subject to these Conditions of Use, and specifically the terms and conditions outlined below.
17. Pilot Project
17.1 – The Chatbot is made available to Winnipeg.ca visitors to use as a pilot project.
17.2 – You must not rely on answers given by the Chatbot. You should verify any answers received by contacting 311 through telephone, or conducting their own verification by directly reading Winnipeg.ca or via alternate, appropriate means. This is particularly important with respect to any answers concerning matters of a financial nature such as payment of bills or taxes.
17.3 – In addition to the disclaimers in section 123, the City makes no representations as to the accuracy of any answer given by the Chatbot, and specifically disclaims all any actual or implied representations or warranties as to the accuracy of such information and any reliance on same, and shall in no way be liable for any damages caused to users of the Chatbot in any way whatsoever, including, without limitation, as a result of reliance on inaccurate AI supplied information.
18. Nature of AI
18.1 – The Chatbot is powered by Google’s Gemini AI. Use of the Chatbot must be in compliance with Google’s terms applicable to same, and by continuing to use the Chatbot, you agree to abide by these Conditions of Use, and to indemnify the City for any costs, damages, or penalties the City may suffer, or which may be brought against the City by third parties, as a result of your use of the AI Chatbot.
18.2 – Insofar as is applicable, you agree that the foregoing terms apply to your relationship with the City regarding the Chatbot. You specifically acknowledge and agree that the City has no direct control over the answers that the Chatbot gives; nor does the City have any access to information you or other Users input into the Chatbot.
18.3 – You must not enter any Personal Information or confidential information into the Chatbot.
19. General
19.1 – These Conditions of Use cannot be assigned or transferred, in whole or in part, by you.
19.2 – These Conditions of Use will ensure the benefit of and be binding upon you and the City’s respective heirs, successors and permitted assigns.
19.3 – All rights and obligations under these Conditions of Use that necessarily extend beyond termination of these Conditions of Use in order to fully achieve their intended purpose shall survive termination of these Conditions of Use, including without limiting the generality of the foregoing, all indemnification provisions, and intellectual property provisions.
19.4 – You agree to be bound by the laws of Manitoba with respect to your use of the website and MyAccount and you agree that any court proceedings relating to your use of the website and MyAccount will take place in the Judicial District of Winnipeg.
19.5 – These Conditions of Use, and any other applicable terms of use or policies as referred to in these Conditions of use constitute and contain the entire agreement between you and the City with respect to this website and MyAccount and supersedes any prior oral or written agreements.
19.6 – In the event that any provision of these Conditions of Use are held by a court or a tribunal of competent jurisdiction to be unenforceable, such provision will be enforced to the maximum extent permissible and the remaining portion of these Conditions of Use will remain in full force and effect.
