Outdoor Smoking By-law

On May 25th, 2011, an Outdoor Smoking By-law was passed by City of Winnipeg Council.  This by-law prohibits smoking in certain outdoor locations.

Why is this by-law in place?
The by-law is the result of public feedback and the City’s commitment to the promotion of a healthy urban environment and support for active living and wellness.

 Where is outdoor smoking prohibited?

30 metres from:

  • athletic fields and outdoor ice rinks (during an organized youth event) -  including all City of Winnipeg or Community Centre owned or operated soccer pitches, baseball or softball diamonds, football fields and outdoor hockey rinks
  • all swimming pools, wading pools, spray pads and spray parks owned and operated by the City of Winnipeg or a Community Centre

At all times on:

  • all playgrounds
  • school properties, including all public and private elementary, middle and secondary schools
  • health care facility properties, including all designated hospitals, personal care homes, Access Centres, Breast Health Centre, Winnipeg Birth Centre, Clinic, Mount Carmel Clinic and Pan Am Clinic

    esidents of personal care homes are permitted to smoke in clearly marked, designated smoking area.

8 metres from outdoor entrance ways to:

  • health care facilities
  • City of Winnipeg workplaces
  • Winnipeg Regional Health Authority workplaces

How will this by-law be enforced?
The City’s primary goal is voluntary compliance with the by-law through public education. Sometimes, however, enforcement is necessary.

The minimum fine for smoking in a regulated outdoor space for the first offence is $100. 
For a second offence, the fine is between $200 and $700. 
Third and subsequent offences will be fined between $300 and $1,000.

What should I do if I see someone smoking in an outdoor location where smoking is prohibited?

Citizens who see individuals smoking in an outdoor location where smoking is prohibited can inform them politely that a Winnipeg by-law prohibits smoking in that particular location.

Individuals who do not feel comfortable approaching someone violating the by-law can call 311 to report the incident.
